TERMS AND CONDITIONS

The following are the terms and conditions under which you will engage the services of FK1 Design: –

Fees:

The structure of payments is specified in your quotation, no variance from this structure is permitted unless previously agreed with FK1 Design. Should you choose to stop work on your project we reserve the right to calculate the fees due based on the number of hours logged to your project, not exceeding the full value of the quotation, up until the date we are told to cease work. This will be charged at our current hourly rate. Invoices are issued following submission of the Planning or Building Warrant applications. All fees are payable within 14 days from issue of invoice. No Planning Permission or Building Warrant decision paperwork will be forwarded to the client until required fees are paid. Failure to do so may result in the withdrawal of services and relevant applications. All scheme designs are to be signed off by the client at Stage C as noted below. Within reason, significant changes to the design after this point may result in additional charges which will be agreed with you prior to progressing of revised sketches. It should be noted that changes to the design may affect your Planning or Building Warrant Approvals and revised application(s) may be required which may incur additional costs to the Local Authority. Estimated Local Authority fees will be noted within our Schedule of Fees and are to be payable directly to the relevant Local Authority as instructed by FK1 Design. It is the responsibility of the client to contract and pay engineers or consultants. An estimated cost will be provided with your quotation however detailed costs will be obtained once detailed plans are produced by FK1 Design.

Expenses:

Our fee includes general expenses such as printing and travel expenses. Any additional fees required, I.e. Ordnance Survey plans, Planning advertisement fees, will be advised and will be payable by the client.

Drawings:

We exclude responsibility for losses due to work based on dimensions, drawings or other materials supplied by the client, or for losses due to work carried out from drawings reproduced by third parties. All dimensions and other critical elements, for example existing drainage layouts to be checked on site by contractor/relevant person prior to commencement of work. Any discrepancies found in the drawings are to be reported immediately to FK1 Design. We exclude responsibility for losses where this procedure is not followed. Drawings to be used solely for the purpose intended, all drawings prepared by FK1 Design are for use up to Building Warrant stage unless previously agreed otherwise and confirmed in writing by FK1 Design.

Requirements:

It is the Clients responsibility to provide any information regarding the site/ building such as boundary lines, easements, covenants and legal description. We exclude all liability for losses that arise from failure to provide such information.

Work Stages:

The range of services provided will be as set out below. Stage A/B: Preparation of the brief. Stage C: Initial Sketch Design. Stage D: To Planning Consent Application. Stage E: To Building Warrant Application. Unless quoted and agreed otherwise, FK1 Design agreement will generally be up to and including Stage E – Building Warrant Approval. FK1 Design will not accept liability where drawings are used beyond this stage. For construction purposes it may be necessary to augment or amend information. We reserve the right to update and amend our standard terms and conditions without prior notice or approval.

Statutory Permissions:

  1. Upon submission of an application to the Planning Department the council have a statutory timescale of 8 weeks to determine (accept or refuse) your application. The Building Warrant application is slightly different in that the local authority have 20 working days to provide an initial technical response. Any request for further information from the local authority will be dealt with promptly by FK1 Design. From experience the Building Warrant process takes around 5-8 weeks depending on the complexity of the works involved. It should be noted that no works are to commence until you have all require statutory approvals in place. Should you start prior to this enforcement action could be raised against you by the local authority.
